If you disagree with any part of these terms, you may not access our platform, purchase our products, or utilize our services.
Permission is granted to temporarily download one copy of the materials, including product documentation, web content, or associated companion applications, on NovaServe B.V.'s platform for personal, non-commercial transitory viewing or usage only.
This is the grant of a license, not a transfer of title. Under this license, you may not modify, copy, or distribute the materials for any commercial purpose or public display; attempt to decompile, reverse engineer, disassemble, or extract the source code, firmware, software, underlying AI models, or proprietary hardware components of our smart toys; remove any copyright or proprietary notations; or transfer or mirror the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by NovaServe B.V. at any time.
NovaServe B.V. specializes in the development, sale, and support of AI-powered interactive toys, models, and related digital companion applications.
We reserve the right to modify, update, or optimize our AI interactive features, software functionalities, or digital content to improve product performance or ensure user safety. While we aim for uninterrupted service, access to cloud-based AI functionalities may occasionally be suspended temporarily for essential maintenance or firmware updates. We will provide advanced notice for scheduled downtime wherever feasible.
To access certain companion applications, cloud-based AI features, or community features, you must create an account.
In accordance with children's privacy laws, accounts must be created and managed by a parent or legal guardian who is at least 18 years old.
You agree to provide accurate, complete, and current information. You are solely responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Pricing & Payments: All fees for physical products, subscription-based AI features, or digital content are payable in advance according to the pricing details displayed at checkout. You authorize us to charge your selected payment method for all fees incurred.
Right of Withdrawal (14-Day Cooling-off Period): In accordance with EU and Dutch consumer protection laws, if you purchase physical AI toys directly from our online store, you have the right to withdraw from the purchase within 14 calendar days from the day of delivery without giving any reason. The product must be returned unused, undamaged, and in its original packaging.
Digital Content Exception: For instant digital content or subscription-based AI interactive services, you acknowledge that by explicitly consenting to immediate performance and access during checkout, you waive your 14-day right of withdrawal for that specific digital service once the performance has begun.
The website, physical products, proprietary AI models, 3D toy designs, original software, algorithms, branding, and all digital features are and will remain the exclusive property of NovaServe B.V. and its licensors.
Our properties are protected by Dutch and international copyright, trademark, patent, and intellectual property laws.
You agree not to use our website, physical AI toys, or digital companion apps to violate any applicable local, national, or international law or regulation.
You agree not to exploit, harm, or attempt to harm minors in any way; maliciously alter, manipulate, or feed harmful inputs into the AI interactive engine to generate illegal or unsafe behavior; or deploy automated web crawlers, scrapers, or bots to extract data from our platform.
Under Dutch law, consumers are entitled to a legal warranty (wettelijke garantie) that products must conform to the contract and perform as reasonably expected for a reasonable lifespan under normal use.
Beyond this mandatory statutory legal warranty, NovaServe B.V. provides its online materials and complementary platform features on an "as-is" basis, and disclaims other implied commercial warranties of merchantability or fitness for a specific unstated purpose to the maximum extent permitted by law.
Nothing in these Terms shall limit or exclude NovaServe B.V.'s liability for death, personal injury, fraud, or damages caused by our willful misconduct (opzet) or gross negligence (bewuste roekeloosheid), which cannot be excluded under Dutch law.
For other commercial damages arising out of the use or inability to use our products or services, NovaServe B.V.'s total cumulative liability shall be limited to the maximum extent permitted by law, and shall not exceed the total amount actually paid by the customer to NovaServe B.V. for the specific product or service during the twelve (12) months preceding the event giving rise to liability.
Our website or apps may contain links to third-party services, such as secure payment processors.
NovaServe B.V. does not control and is not responsible for the content, privacy policies, or practices of any third-party websites.
NovaServe B.V. reserves the right to revise these terms of service to reflect regulatory adjustments, technology changes, or updates to our product lines.
We will notify you of any material changes by posting the updated terms on this page and updating the "Last updated" date.
For users with active recurring AI subscriptions, we will notify you via email at least 30 days prior to any material changes taking effect. If you do not agree to the amended terms, you have the right to cancel your subscription before the changes become active.
These Terms and Conditions are governed by and construed in accordance with the laws of the Netherlands.
Any disputes arising out of or in connection with these terms, our products, or our services shall be submitted exclusively to the competent jurisdiction of the District Court of North Holland (Rechtbank Noord-Holland) in the Netherlands.
